Grounds for Deportation
Are you at risk of deportation?
Once admitted to the United States as a permanent resident, you may still be subject to deportation in light of certain circumstances. Contact a Queens criminal defense lawyer right away if any of the following apply to you:
- Violating your status. This may involve being found to have been inadmissible at time of entry or failing to maintain resident status in that you are judged to have established residency elsewhere. Being in violation of the Immigration and Nationality Act and related laws can also result in deportation. This would include remaining in the United States longer than authorized or entering the United States without inspection. Aliens who have encouraged or assisted illegal immigration may be subject to deportation, as with those who entered into a fraudulent marriage to obtain immigration benefits.
- Becoming a public charge within five years of immigrating due to causes that existed before you entered the United States.
- Engaging in activity relating to terrorism, espionage, sabotage, or export of goods, technology or sensitive information from the U.S., in violation of United States law. Other activity which threatens national security or public safety or has the purpose of opposing or overthrowing the government by unlawful means is included here.
- Failing to register a change of address with the USCIS or being convicted of a crime relating to fraud or misuse of visas.
- Voting in violation of the restrictions placed on aliens.
-
Admitting to or being convicted of certain crimes, such as aggravated felonies, crimes of
moral turpitude,
drug crimes,
firearms offense,
domestic violence, and others.
